This Privacy Policy explains how personal information is collected, held, used and disclosed in connection with Laterpath and related SMSF administration services. For this policy, “we”, “us” and “our” mean ESUPERFUND Pty Ltd as Trustee for ESUPERFUND Trust (AFSL 340762, ABN 37 842 535 715) and related companies providing the services. Laterpath is a brand of that entity.

We are bound by the Privacy Act 1988 (Cth), including the Australian Privacy Principles (APPs).

Collection of personal information

You may provide personal information when you request information, use laterpath.com.au (or affiliated sites and apps), submit an application, or become a client. In most cases we collect information directly from you. If you provide information about another person, you represent that you are authorised to do so and will inform them of this policy.

We may collect identity and contact details (such as name, address, email, phone and date of birth), fund details, and other information required to identify you, provide services, or meet legal obligations. We usually do not need sensitive information; if we do, we will seek consent except where the law permits otherwise.

If you do not provide information we reasonably request, we may not be able to respond to your enquiry or provide SMSF services.

Use of personal information

We use personal information to provide, manage and administer SMSF establishment and administration services; communicate with you; meet legal and regulatory obligations; improve our websites; and, where permitted, send marketing messages (you may opt out).

Disclosure of personal information

We do not sell personal information. We may disclose information to employees, contractors, agents and service providers who help us deliver services; to auditors, insurers or professional advisers; and to regulators or law enforcement where required or authorised by law. Overseas disclosure may occur to support service delivery (historically including locations such as Singapore and China); where this happens we take steps so appropriate data handling arrangements are in place.

Access and correction

You may request access to, or correction of, personal information we hold about you. Contact the Privacy Officer using the details below. We may need to verify your identity. There is no fee for making a request; a reasonable access charge may apply for providing large volumes of information.

Complaints

Privacy complaints may be sent to the Privacy Officer. We aim to resolve complaints promptly. If you are not satisfied, you may contact the Office of the Australian Information Commissioner (OAIC) — oaic.gov.au or 1300 363 992.

Security and cookies

We take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access or disclosure. Our websites may use cookies and similar technologies for statistics, site function and (where used) advertising measurement. You can adjust browser settings to refuse cookies; some site features may not work fully.
